"After deliberation on Biocrawler:Fair use, it has been decided that it is eligible for fair use under United States law" is not a useful statement. It is purely conclusory; such a bare ascertion will help no one. Where has this discussion occurred? Were the four factors discussed in detail in relation to case law? Please remember that you cannot just decide that something is eligible for fair use, YOU MUST DISCUSS THE SPECIFIC USE, i.e. the article it is put in. It may be fair use in one article and not fair use in another article. There is no such thing as a general concept of "fair use". An image cannot have the status of "fair use" independent of a use. THAT USE MUST BE ANALYZED. Also just because something is commercial (educational) or non-commercial (non-educational) does not mean that it is non-fair use or fair use possible.
